Michael Barratt (Birmingham, AL) (Workers’ Compensation) obtained a Defense Verdict in a Workers’ Compensation claim. Plaintiff claimed to be permanently and totally disabled due to extensive injuries to his back, neck, and lower extremities he claimed were the result of a forklift accident at work. Defense was able to show the Plaintiff had an extensive history of pre-existing conditions that were not aggravated by the accident. The Judge ruled that the Plaintiff’s condition was the result of pre-existing conditions and ruled in favor of the Defendant.
