Plaintiff v Homeowner Association (FDCPA)

Matthew Collett (North Florida/Jacksonville) (D&O) obtained final summary judgment in favor of a Homeowner’s Association sued for alleged violations of the federal Fair Debt Collection Practices Act (FDCPA) related to the Association’s collection of dues and assessments from Plaintiff. The court concluded that the Association was not a debt collector” within the meaning of the FDCPA, and therefore, the Association was entitled to final summary judgment.
