Jacob Malatesta (Jackson, MS) (Medical Malpractice) Our firm recently obtained an excellent result for a Mississippi hospital in a medical malpractice action involving allegations of negligent care following treatment of a patient diagnosed with Slipped Capital Femoral Epiphysis (SCFE) and subsequent avascular necrosis (AVN) of the hip. The patient had fallen prior to arrival at the hospital, and the hospital immediately conducted emergency surgery to stabilize the fracture. Despite the best efforts of the talented medical staff, the patient developed AVN. The case was procedurally complicated by the filing of two separate causes of action regarding the same injury.
After a thorough review of the medical records, discovery, and motion practice addressing expert disclosures and damages, and in light of related litigation involving a separate incident, plaintiff was forced to admit that the evidence confirmed that there was no breach of the applicable standard of care by the hospital or its physicians. The plaintiff ultimately voluntarily dismissed the case, acknowledging that no expert testimony existed to support any claim against the medical providers involved.
