Vernis & Bowling secures a Summary Judgment win in a multi-million dollar wrongful death/construction accident case.
Attorneys Kenneth Amos, Brandt Carlson, Anthony True, and paralegal Brittney Walters (St. Petersburg, FL) (Construction) recently obtained Summary Judgment in their clients’ favor, and against allegations of negligence, gross negligence, and wrongful death brought by the estate of a decedent who tragically lost his life in a trench collapse on a Punta Gorda construction project.
Vernis & Bowling’s defense team successfully argued that their clients, as construction managers, did not owe or otherwise assume a duty to control the safety practices or standards employed by the decedent as an independent contractor engaged in trenching work under binding Florida law. The Decedent’s estate continues to pursue other parties involved in the construction accident and is expected to appeal this ruling. We will continue to zealously advocate for our clients, and will now be seeking to recover attorneys’ fees and costs against the Plaintiff based on their failure to accept a prior proposal for settlement served by the Defense.
