Evan Zuckerman (Hollywood, FL) (Appeal) obtained an appellate victory where the Third District Court of Appeal affirmed Summary Judgment for Citizens following the exclusion of Plaintiffs’ expert under Florida’s Daubert standard.
Mr. Zuckerman successfully defending the trial court’s ruling that the expert opinions, based on unreliable data and untested methodology, were inadmissible. The Third DCA issued a per curiam affirmance with a string citation, expressing agreement with the legal theories in our answer brief, citing additional authority, and strengthening the precedential value of the decision. The court denied Appellants’ motion for rehearing en banc and granted Citizens’ motion for appellate attorneys’ fees.
This outcome underscores our firm’s strength in preserving critical trial court wins on appeal and excluding speculative expert testimony through focused Daubert challenges.
