Evelyn Greenstone Kammet (Miami, FL) (Appeal) On September 23, 2024, we obtained Summary Final Judgment against Plaintiff who had sued her condominium association, its board members, the members of its fining committee, its property managers, and its property management company in the District Court for the Southern District of Florida on claims alleging race-based and sex-based housing discrimination and harassment, violations of the Condominium Act, breach of fiduciary duty, and gross negligence. Plaintiff appealed the District Court’s ruling, and Ms. Greenstone Kammet successfully defended the appellate action. By written Order dated August 7, 2026, after a total of six years of litigation, the United States Court of Appeals for the 11th Circuit affirmed the trial court’s ruling. Ms. Greenstone Kammet was additionally successful in obtaining a substantial award of prevailing party attorney’s fees and costs against Plaintiff for the amounts her clients incurred defending Plaintiff’s claims.
