Plus Restoration a/a/o Remigio Martinez v. Citizens Property Insurance Corporation

Chris Sabater and Cristina Bianchi (Miami, FL) (Property) obtained a Defense Verdict in favor of Citizens Insurance in Miami-Dade County. The case was a Breach of Contract action filed by a water mitigation company pursuant to an assignment of benefits against Citizens for unpaid services. The issues in the case involved: (1) invalid assignment of benefits; (2) services not performed in accordance with industry standards; and (3) the $3,000 statutory cap for emergency services. The jury deliberated for a little over an hour and returned with a full Defense Verdict in favor of Citizens ($0 owed to Plaintiff). Plaintiff was asking for $19,000 in damages. We will be seeking attorney’s fees and costs from Plaintiff as Defendant’s PFS was previously rejected.
