William G. Hyland Jr. (Deland, FL) (Automobile Liability) obtained a Complete Dismissal of this case after filing a Motion to Dismiss, and Summary Judgment Motion with a Memorandum of Law, in a case in which the Plaintiff demanded more than $100,000 in damages.
The facts of the case were as alleged: On or about September 6, 2023, it is alleged the Plaintiffs, George Lopez (driver) and Caroline Vardavas (passenger), were driving on Dr. Mary McLeod Bethune Blvd in Volusia County, Florida. While Plaintiff Lopez was driving, Plaintiffs allege that they were hit (T Boned on the passenger side) by another vehicle driven by Co-Defendant, Hansel Johnson, after Johnson ran a red light through the intersection of Keech Street and Dr. Mary McLeod Bethune Blvd. Plaintiffs further allege that our client Defendant (JOHNSON) negligently and carelessly operated and/or maintained his vehicle crashing into Plaintiffs vehicle after the initial collision. After taking sworn depositions, there was no credible record of evidence that our client, GREGORY CAMPBELL, caused or contributed to the accident, or was negligent, after the initial collision. We filed a Motion for Summary Judgment which prompted the Plaintiff attorney to withdraw from the case. The court ordered Plaintiff to obtain new counsel within 30 days, which they failed to do. Upon filing our Motion to Dismiss, the case was dismissed by the Court on January 5, 2025.
