In a recent U.S. Supreme Court decision, Stanley v. City of Sanford, Florida, the Court made it clear that a “qualified individual” under Title I of the Americans with Disabilities Act applies only to current employees or people seeking jobs; and as such it did not extend to retirees – those who are not employed or seeking employment. However, the Court did go out of its way to address a potential path for retirees who could show that they were disabled and qualified when the alleged discriminatory policy was adopted.
