Final Compensation Order (Florida Heart & Lung Bill )

Jerry M. Hayden (Miami) (Workers’ Compensation) obtained a Final Compensation Order denying all benefits in a claim brought pursuant to the Florida Heart & Lung Bill for compensability of an employee’s heart disease and a resulting heart attack. The defense successfully overcame an adverse Expert Medical Advisor’s opinion which is presumed correct absent clear and convincing evidence to the contrary. Mr. Hayden also recently obtained favorable resolution of a traumatic brain injury case involving significant exposure and issues of statutory employer relationship and complex medical causation.
